1. NBSLSS Loyalty Terms and Conditions
1.1 These Terms and Conditions govern “NBSLSS Loyalty” rewards program known as NBSLSS Loyalty. It is the responsibility of every Member to read and understand them.
1.2 These Terms and Conditions may be amended by NBSLSS Loyalty, from time to time in accordance with clause 4. Any amendments to the Terms and Conditions will be available on request at the Venue or the url http://NBSLSSreward.com.au/terms-conditions/ and take effect immediately at the time they appear on the url provided
2. Definitions
In these Terms and Conditions unless the context otherwise requires:
‘Approved’ means approved by NBSLSS Loyalty
‘NBSLSS Loyalty’ means the loyalty program that operates at NBSLSS
‘NBSLSS Loyalty Staff Member’ means an employee, agent or contractor of NBSLSS Loyalty, its Related Bodies Corporate or any Participating Venue;
‘Australian Consumer Law’ has the meaning given in the Competition and Consumer Act 2010 (Cth);
‘Benefits’ means any discounts, bonuses, prize draws or other arrangements offered or available to a Member as a result of Membership, including earning and redeeming loyalty points;
‘Brands’ means loyalty apps and loyalty systems and offers know as NBSLSS Loyalty, Bobs Bulk Booze and Sense of Taste.
‘Games’ means games played on a device regulated under the Gaming Machines Act of the state where the game is played by the member and which is commonly known as a ‘poker machine’;
‘Gift Card’ means a gift card issued to a Member as a Reward pursuant to these Terms and Conditions, which may be used for payment, towards the goods and services offered by a third party, up to the dollar value stored on the gift card. The Gift Card is valid for the period for time allocated by the laws for Gift Cards used in QLD at the time of purchase.
‘Member’ means a person who is a member of NBSLSS Loyalty and recorded in the database of NBSLSS Loyalty.
‘Membership’ means membership of NBSLSS Loyalty;
‘NBSLSS Loyalty Card’ means the physical card issued by NBSLSS Loyalty to its Members. The Card contains a unique number that identifies the Member. These Cards can only be used in the Gaming Machines.
‘NBSLSS Loyalty App’ means an online rewards card that is accessed by the internet and after successful registration provides a digital loyalty card to be used in the POS “Point Of Sale”.
‘Loyalty Points’ means the points awarded to Members in NBSLSS Loyalty pursuant to these Terms and Conditions;
‘Participating Venue’ means a venue that is participating in NBSLSS Loyalty in the provision of the Benefits and/or Rewards in accordance with these Terms and Conditions.
Such Participating Venues may change from time-to-time and without notice.
‘Personal Information’ means any information or opinion (irrespective of the medium in which this is stored or kept) about Members, whether true or not, from which the identity of Members can be reasonably ascertained including without limitation:
Details such as but not limited to:
- patronage of the Venue, use of Member Pre-Commitment, Points that you have accrued, details in relation to requests you have made for Rewards (and the outcome of those requests); and
- your personal details such as name, address, phone number, email address, date of birth and any other information provided in your Membership application form or from visits to participating venues.
- General information gathered at the Venue regarding the Member.
‘PIN’ means the personal identification number which is issued to the Member by NBSLSS Loyalty or nominated by the Member for verification purposes;
‘Promotional Offers’ means targeted promotional offers to Members or groups of Members that may change from time to time;
‘Related Bodies Corporate’ has the meaning given to it in the Corporations Act 2001 (Cth);
‘Rewards’ means items, Venue Vouchers, Gift Cards, Third Party Offers, goods or services described as loyalty rewards from time to time that are available to a Member as a result of achieving certain criteria;
‘Terms and Conditions’ means these terms and conditions as amended from time to time;
‘Third Party Offer’ means an offer to a Member made by an approved third party permitted by, but not related to NBSLSS Loyalty.
‘NBSLSS Loyalty Staff’ means any staff member working as a contractor employee for a participating Venue or is employed by NBSLSS Loyalty.
‘NBSLSS Voucher’ means a voucher issued to a Member as a Reward pursuant to these Terms and Conditions, which may be used for payment, towards food and beverages offered subject to the NBSLSS Voucher terms and conditions at the time of issuing.
‘Member Pre-Commitment’ means the ability for Members to voluntarily set time and net loss limits on electronic gaming machine play under NBSLSS Loyalty, which once reached, results in electronic notification to the Member and prevents the Member from earning any further NBSLSS Points as a result of subsequent electronic gaming machine play until a predetermined period of time has passed.
3. Membership & Rating Grades
3.1 Membership is only available to Australian residents who are aged 18 years or over. Membership is not available to Employees of NBSLSS, its Related Bodies Corporate, or Participating Venues.
3.2 A person may apply to become a Member by Registering through the NBSLSS Loyalty Loyalty APP using a unique Mobile number that is registered to the Member.
By the Member completing the registration process in the NBSLSS Loyalty Loyalty APP the Member agree’s to be bound by these Terms and Conditions. The Terms and Conditions are available during sign up process or in the Loyalty App under “What’s On” called Terms and Conditions.
If a member does not have a mobile phone compatible with the NBSLSS Loyalty Loyalty App and or cannot install the Loyalty APP and register on the APP then the membership can be refused at the discretion of NBSLSS Loyalty.
3.3 A person’s Membership becomes effective when the NBSLSS Loyalty database has received the members information and a NBSLSS Card has been issued digitally at which time the Member application shall be deemed accepted by NBSLSS Loyalty and the Member will thereby, without more, be bound by these Terms and Conditions.
3.4 Identification may be requested by a participating venue , NBSLSS Loyalty will accept the following forms of identification which include a current driver’s licence or learner permit, current passport, proof-of-age card, Keypass (in all States or Territories other than NSW and WA), or foreign driver’s licence if such documents contain a photo of the person to whom it is issued and indicate by reference to the person’s date of birth or otherwise that the person has attained the age of 18.
3.5 Membership is granted and maintained at the discretion of NBSLSS Loyalty.
3.6 NBSLSS Loyalty may exclude or suspend any person from participation in NBSLSS Loyalty, without cause and NBSLSS Loyalty is not required to provide a reason for the suspension or exclusion.
3.7 The Member undertakes to notify NBSLSS Loyalty as soon as possible, through a Participating Venue, of any change of name, address or other identifying details and present appropriate identification as required to validate such change.
3.8 Members that are excluded or self-excluded from any Participating Venue may have their Membership suspended or terminated and their reward points forfeited.
3.8.1 if the NBSLSS Loyalty Management considers that the Member has breached the terms and conditions of the NBSLSS Loyalty Membership then Management may cancel any points on the members account or Cancel the Membership or both.
3.9 Rating Grades
The Loyalty Program offers different rating levels and each rating level may offer different benefits to a member. The Rating Grades are reviewed regularly and may be changed without notice to the Member. The Rating Grade may go up in a level or be re-graded down a level at the discretion of NBSLSS Loyalty.
A Member can see what their Rating Level is by downloading the Loyalty App which will clearly display their current Rating Level.
4. Changes to NBSLSS Loyalty
4.1 NBSLSS Loyalty may make any changes (whether material or otherwise) to NBSLSS Loyalty from time to time and without prior notice to the Member, including without limitation, the Terms and Conditions and associated Benefits, Rewards or Member Pre-Commitment features or any other NBSLSS Loyalty member benefit or offer.
4.2 It is every Member’s responsibility to ensure that they keep themselves informed of any amended Terms and Conditions and associated Benefits, Rewards or Member Pre-Commitment features by requesting a copy of NBSLSS Loyalty Terms and Conditions from a participating Venue or accessing the following url. http://NBSLSSreward.com.au/terms-conditions/
4.3 NBSLSS Loyalty may, at any time, cancel a NBSLSS Loyalty Membership in whole or in part or suspend it for any reason after 30 days’ notice. Upon cancellation, any Loyalty Points which have not been redeemed will immediately and automatically be deemed surrendered by the Member and cancelled.
5. Membership
5.1 A person is only entitled to one Membership account and is permitted only one NBSLSS Loyalty Membership. If a Member has 2 seperate memberships then one of the memberships will be automatically canceled without notice and the points maybe forfeited on the account that is closed.
5.2 Any physical NBSLSS Loyalty Card or the NBSLSS Loyalty Loyalty App remains the property of NBSLSS Loyalty and must be returned to a NBSLSS Loyalty Staff Member or designee on request or if using the NBSLSS Loyalty Loyalty App the App is to be deleted.
5.3 Without prejudice to clause 3.3, each use of a Member’s NBSLSS Card is deemed acceptance of these Terms and Conditions.
5.4 It is the sole responsibility of the Loyalty Member to protect unauthorised use of their Loyalty Membership and take precautions against loss or unauthorised use.
5.5 A NBSLSS Card issued to a Member may only be used by that Member for the purposes of their Membership. The Member must not give their NBSLSS Membership by any means to another person or Member for any purpose whatsoever. A NBSLSS Loyalty Staff Member or designee may require a person to produce identification satisfactory to that NBSLSS Loyalty Staff Member for the purposes of verifying that a NBSLSS Card is being used by the relevant person to whom it was issued and such person must immediately comply with such request.
If a members loyalty is used by any other person other than themselves then the Loyalty Membership can be cancelled without notification and the points forfeited.
5.6 Members must notify NBSLSS Loyalty as soon as reasonably practical, through a Participating Venue, loss or theft of their NBSLSS Card. NBSLSS Loyalty may replace a damaged, lost or stolen NBSLSS Card at its discretion subject to the relevant Member satisfying NBSLSS Loyalty’s identification requirements. NBSLSS Loyalty may at its discretion charge a reasonable cost of replacement of the card or deduct the value of the replacement from the members points balance.
6. NBSLSS Points and Benefits
6.1 The Value of a NBSLSS Point is 1 point = 1 cent
6.2 NBSLSS Loyalty may place a cap on the Point earning capacity of an individual Member.
6.3 NBSLSS Points and Benefits cannot be transferred to another Member and can only be used by the Member whose name appears on the NBSLSS Card.
6.4 Benefits are offered subject to availability. NBSLSS Loyalty and its Related Bodies Corporate shall not be responsible for the unavailability or withdrawal of any particular Benefit. NBSLSS Loyalty may limit the goods and services on which Loyalty Points may be earned and Benefits applied.
6.5 Particular Benefits may be subject to terms and conditions in addition to these Terms and Conditions.
6.6 Benefits cannot be used in conjunction with any other promotional offer or discount, unless otherwise specified in the terms and conditions of a particular offer or promotional event. If more than one benefit is available to a NBSLSS Loyalty Member, then NBSLSS Loyalty will make the decision which benefit will apply to the member(s).
6.7 In order to earn Loyalty Points or Benefits, it is the Member’s responsibility to ensure that their Loyalty Membership has been presented at the time of the transaction and accepted. If a gaming machine is being played that the NBSLSS Loyalty Card has to be correctly inserted into the gaming machine and that the Gaming Machine has accepted the card as active.
6.8 It is the Member’s responsibility to check at the time of the transaction that Loyalty Points have been correctly allocated to their NBSLSS Card and immediately notify a Participating Venue of any discrepancies.
6.9 NBSLSS Loyalty may adjust the Member’s Loyalty Points or Benefits at NBSLSS Loyalty’s sole discretion.
6.10 Loyalty Points will expire 12 months from when they are first earned and any unused Loyalty Points will no longer be available to the member. Benefits may expire at intervals set by NBSLSS Loyalty.
6.11 NBSLSS Points and Benefits cannot be re-credited once they have expired.
6.12 NBSLSS Loyalty may reverse or cancel any Loyalty Points credited to a Member incorrectly or not in accordance with the Terms and Conditions.
6.13 NBSLSS Loyalty and its Related Bodies exclude and limit liability in relation to Loyalty Points and Benefits pursuant to the terms of clause 14.
6.14 If points have not accrued on a Member Account at a NBSLSS Loyalty or a participating venue, NBSLSS Loyalty is not required to replace the points. It is the responsibility of the Member to check that points are accumulating correctly.
7. Rewards
7.1 Members may exchange Loyalty Points for approved Rewards these rewards may be replaced from time to time by NBSLSS Loyalty without notice.
7.2 Rewards are offered subject to change and availability. NBSLSS Loyalty shall not be responsible for the unavailability or withdrawal without notice of any particular Rewards and may accept or reject any request to receive a Reward.
7.3 NBSLSS Loyalty will determine the number of Loyalty Points required to redeem a Reward and may change the number of Loyalty Points required to redeem any Reward at any time without notice to the Member.
7.4 In exchanging NBSLSS Points for Rewards, the Members must present their Membership to a Participating Venue and comply with any validation and identification tests required by NBSLSS Loyalty Staff Members, including, without limitation providing their name, address, date-of-birth and/or PIN or Digital App.
7.5 A Member’s Loyalty Points may not be combined with any other Member’s NBSLSS Points to claim Rewards.
7.6 Once issued, Rewards cannot be refunded, returned or exchanged for cash or replaced if lost or stolen. No change can be given on the unused portion of a Reward.
7.7 Particular Rewards may be subject to further terms and conditions in addition to these Terms and Conditions.
7.8 NBSLSS Loyalty and its Related Bodies Corporate exclude and limit liability in relation to Rewards pursuant to the terms of clause 14.
8. Promotional Offers
8.1 NBSLSS Loyalty may make Promotional Offers to individual Members or groups of Members and to the exclusion of other Members. Promotional Offers may include Benefits, Loyalty Points and Rewards subject to the terms and conditions of the Promotional Offers.
8.2 NBSLSS Loyalty and its Related Bodies Corporate exclude and limit liability in relation to Promotional Offers pursuant to the terms of clause 14.
8.3 If in the event that a member receives an offer or other benefit from NBSLSS Loyalty by email, SMS or other communication and it is in the opinion of NBSLSS Loyalty that member should not have received the offer and it was sent in error. Then NBSLSS Loyalty may choose not to honour the offer.
9. Third Party Offers
9.1 NBSLSS Loyalty may notify Members of Third Party Offers from time to time. Even though NBSLSS Loyalty may provide a Member with the notification, Members acknowledge and agree that Third Party Offers are not provided by NBSLSS Loyalty or a Participating Venue, but by third parties.
9.2 Third Party Offers may be subject to additional terms and conditions of the third party supplier and may be withdrawn at any time without notice or giving reasons.
9.3 NBSLSS Loyalty and its Related Bodies Corporate exclude and limit liability in relation to Third Party Offers pursuant to the terms of clause 14.
10. Personal Identification Number (PIN)
10.1 NBSLSS Loyalty may request a Member to select a PIN in a format required by NBSLSS Loyalty.
10.2 Members must not disclose their PIN to another person or Member.
10.3 A PIN may only be selected or reset by a Member upon presentation of appropriate identification
to NBSLSS Loyalty as outlined in clause 3.4.
10.4 NBSLSS Loyalty or its Related Bodies Corporate will not be liable for any unauthorised use of Benefits or Rewards as a result of a NBSLSS Card being lost or stolen or if a PIN has become known to another person.
11. Opt-out/Surrender/ Suspension / Termination of Membership
11.1 If the Member wishes to surrender their Membership they may do so at any time by notifying a NBSLSS Loyalty Staff Member at a participating Venue and return surrender their Member Card to the participating Venue employee.
11.2 NBSLSS Loyalty may suspend or terminate a Member’s Membership, where it has determined that a Member has failed to comply with these Terms and Conditions, has engaged in dishonest or fraudulent activity, has been intimidating or disruptive to patrons or staff, is suffering mental incapacity, is causing or is likely to cause repetitional damage to NBSLSS Loyalty and/or its Related Bodies Corporate and/or a Participating Venue or where required to do so by law.
11.3 Membership will immediately and automatically terminate upon the death of the Member.
11.4 Unless NBSLSS Loyalty determines otherwise, if a Member’s Membership has been suspended, that Member will not be entitled to participate in NBSLSS Loyalty, earn any NBSLSS Points, take advantage of Member Pre-Commitment, take advantage of Benefits, or claim any Rewards pending further notice from NBSLSS Loyalty.
11.5 Unless NBSLSS Loyalty determines otherwise, upon termination of a Member’s Membership, any NBSLSS Points that have been accumulated by the Member will immediately and automatically be deemed surrendered by the Member and cancelled.
12. Pre-Commitment
Member Pre-Commitment is available at a participating venue that has pre-commitment for gaming, please ask the Venue if they have pre-commitment if you are unsure.
12.1.1 Members may opt in to voluntary pre commitment if used in conjunction with their NBSLSS Reward Card.

12.1.2 If utilised, the Member Pre-Commitment will allow a Member to set a limit on:
- the amount of time, in a 24 hour period determined by NBSLSS Loyalty, that the Member may play Games using their NBSLSS Card; and/or
- the Member’s net loss, in a 24 hour period determined by NBSLSS Loyalty, on Games played using their NBSLSS Card.
12.1.3 If a limit referred to in clause 12.1.2 above is reached, the Member will receive an electronic notification superimposed on the screen of the machine upon which the Game is then being played. At that time, although the Member may continue playing Games, the Member will cease to earn NBSLSS Points as a result of any further Games played before the commencement of trading at a Participating Venue on the next trading day.
12.1.4 If a Member has set a limit referred to in clause 12.1.2 above, any new limit set by the Member that increases the amount of time or net loss, will not take effect until commencement of trading at a Participating Venue on the next trading day.
12.1.5 If a Member has set a limit referred to in clause 12.1.2 above, any new limit set by the Member which decreases the amount of time or net loss, will take effect immediately.
12.2.7 A player activity statement regarding the Member’s playing of Games under NBSLSS Loyalty will be made available to the Member on request at a Participating Venue. The player activity statement will be provided free of charge.
12.2.8 NBSLSS Loyalty and its Related Bodies Corporate exclude and limit liability in relation to Member Pre-Commitment pursuant to the terms of clause 14.
13. Privacy
13.1 By becoming a Member, Members agree that NBSLSS Loyalty may collect, use and disclose Members’ Personal Information. Your information is shared with our Loyalty Partner ‘Qantum Network’ who may manage the loyalty ratings and benefits on NBSLSS Loyalty behalf. Qantum Network may use this information to provide offers, additional benefits and rewards. Share details with other Qantum Loyalty managed Venues and partners for registration and analysis.
13.2 if you Register at another Qantum Network managed venue or brand, you give permission for your information to be validated so you do not need to re-enter your personal details to complete registration.
13.2 NBSLSS Loyalty may use Personal Information collected about each Member for the purposes of:
13.2.1 meeting any of its commitments to a Member;
13.2.2 disclosing that information to any third party service provider who it engages to assist in meeting its commitments to Members;
13.2.3 marketing products or services to Members;
13.2.4 disclosing that information to a third party service provider who it engages to assist NBSLSS Loyalty in marketing products or services to Members;
13.2.5 improving customer service (including by product development, research and marketing initiatives and analysis (including analysis of a Member’s acquisition of goods and services));
13.2.6 complying with any law or administrative requirement of any government, regulatory or judicial agency and
13.2.7 allowing any Related Bodies Corporate or a Participating Venue to direct market their products or services to Members.
13.3 If persons do not provide all or some of the Personal Information that is requested, NBSLSS Loyalty may refuse Membership or terminate membership after the person has become a member.
13.4 Generally, NBSLSS Loyalty uses systems located within Australia. However, from time to time we may send your information overseas to service or product providers or other third parties who operate or hold data outside Australia or its external territories. Where we do this, the overseas recipients are likely to be located in India and we take reasonable steps to ensure that appropriate data handling and security arrangements are in place.
13.5 Members are responsible for ensuring that Personal Information held is correct and complete. NBSLSS Loyalty’s Privacy Policy contains information about how Members can access Personal Information held by NBSLSS Loyalty and seek correction of such Personal Information. Privacy law requirements regarding the rights of Members to review and correct any Personal Information are applicable to any Personal Information NBSLSS Loyalty holds about Members.
13.6 Members expressly consent to receiving marketing and promotional material from NBSLSS Loyalty, its Related Bodies Corporate or any existing or prospective Participating Venue in relation to NBSLSS Loyalty. Members may opt-out of receiving such material by following the process advised to them in that material.
13.7 Members expressly consent to the receipt of marketing and promotional material from NBSLSS Loyalty, its Related Bodies Corporate or any existing or prospective Participating Venue by post, SMS, MMS, email or any other electronic form.
13.8 NBSLSS Loyalty’s Privacy Policy contains information about how Members can complain about a breach of the Australian Privacy Principles and how NBSLSS Loyalty deals with such complaints.
14. Limitation of Liability
14.1 To the extent that NBSLSS Loyalty and/or anything received by a Member pursuant to these Terms and Conditions constitutes a supply of goods or services to a consumer within the meaning of the Australian Consumer Law, NBSLSS Loyalty and its Related Bodies Corporate do not exclude, restrict or modify any non-excludable obligations, terms, conditions, guarantees or warranties. In all other respects and to the extent permitted by law:
(a) NBSLSS Loyalty and its Related Bodies Corporate exclude all liability whether arising in tort (including, without limitation, negligence), contract or otherwise for any personal injury or any other loss or damage (including, without limitation, loss of opportunity, loss of profits or any other monetary loss or damage) whether direct, indirect, special or consequential, arising in any way, whether directly or indirectly, out of NBSLSS Loyalty;
(b) NBSLSS Loyalty and its Related Bodies Corporate exclude all express and implied warranties relating in any way, whether directly or indirectly, to NBSLSS Loyalty; and
(c) NBSLSS Loyalty and its Related Bodies Corporate limit liability to allocating to the relevant Member’s NBSLSS Card the number of Points and/or Benefits which NBSLSS Loyalty considers appropriate in connection with the circumstances in which the relevant claim arose.
15. General
15.1 Unless otherwise specified where NBSLSS Loyalty or a NBSLSS Loyalty Staff Member exercises a right or discretion under these Terms and Conditions, it does so in its absolute discretion and without giving notice or reason.
15.2 If any provision of these Terms and Conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed from these Terms and Conditions and rendered ineffective as far as possible without modifying the remaining provisions of these Terms and Conditions, and shall not in any way affect any other circumstances of or the validity or enforcement of these Terms and Conditions.
15.3 NBSLSS Loyalty’s decisions in respect of NBSLSS Loyalty are final and binding.
15.4 Any tax liabilities and other duties arising from the accumulation and redemption of NBSLSS Points,
and the receipt of any Benefits and/or Rewards are and remain the sole responsibility of the Member.
My Cash
The following terms and conditions apply to the members use of a card based gaming account (Account) established with the Venue (the Venue being referred to below as us or we):
We are responsible for any loyalty points associated with your card and which goods and services you may be able to purchase with your card from us. Maxgaming Qld Pty Ltd (MAX) is the system provider and responsible for the maintenance of your Account.
1. Consent. By establishing an Account with us you consent and agree to these terms and conditions.
- Minimum Age. You must be 18 years of age or over to establish an Account with us.
- Account Use. Your Account may be used to purchase goods and services which our Venue is permitted to supply to you. This includes the playing of gaming machines in our Venue. You must present your Account card and provide a valid PIN or other verification information to withdraw funds from your Account at our Venue. Your Account may only be used at our Venue, or any other participating venue within our group which has agreed to accept your Account card. The identity of venues which have agreed to accept your Account card may change from time to time.
4. Rules. In all instances the use of your Account and the use of gaming machines by you in our Venue are governed by the Rules Ancillary to Gaming. You may inspect a copy of the rules referred to above at our Venue. To the extent of any inconsistency between these terms and conditions and the relevant rules, the relevant rules prevail.
5. Security. It is your responsibility to keep your Account PIN and other verification information secure. You should not record this information on your Account card nor keep it with your Account card. We accept no responsibility for loss suffered as a result of your failure to keep such information secure.
6. Lost Card. If your Account card or your Account PIN or other verification information is stolen or lost, you should report it to us immediately by notifying a cashier. Any loss suffered from the misuse of your Account prior to such notification is your liability.
7. Closure of Accounts. We or MAX may close your Account at any time. MAX may, at their absolute discretion, charge an account closing fee on any inactive account which is closed. An inactive account is an Account that has no activity (game play, deposits or withdrawals) for a period of 12 months or longer. This account closing fee is non-refundable and is $15 as from 1 April 2017 or the full credit left on an account if it is less than $15. If any registered account where you have provided your personal details becomes inactive with a balance of $15 or more, the balance of the account less the account closing fee if it is charged by MAX, will be paid by cheque or Electronic Funds Transfer to the address or account details you provided. If any visitor account, where you have provided no personal details, becomes inactive the entire balance, less any account closing fee if it is charged by MAX, will be forwarded to the Queensland Office of Liquor and Gaming Regulation.
8. Charges. Charged incurred by us arising from dishonoured deposits or from the transfer of funds to your Account will be charged to your Account.
9. Currency. All references to currency in these terms and conditions and in your Account are references to Australian dollars.
